Like virtually every sphere of business activity, the international arbitration arena has had to face, and overcome, numerous challenges in recent times.

Chief among these has been the need to conduct proceedings virtually – a requirement that could have brought huge disruption. However, testifying to the resilience of arbitration practitioners, this form of alternative dispute resolution (ADR) has adapted accordingly, with web-based technologies allowing arbitral institutions to continue to manage hearings as smoothly as possible.

Internationally, the arbitration community is well-placed to respond to the challenges posed by a range of issues, including geopolitical instability, increasing trade tensions and regulatory upheaval, all of which have the potential to result in a flood of new disputes.

Going forward, whether the trend toward arbitration via electronic filings and virtual hearings will continue is unclear, but what is certain is that international arbitration will retain its status as a robust mechanism that allows disputing commercial parties to reach a resolution, even in these most trying of times.
