The last couple of years have been turbulent for international arbitration. Arbitral institutions have been required to handle significant case loads despite the onset of the coronavirus (COVID-19) pandemic. Cases linked to global supply chain issues, contract performance, closures and construction delays, among others, have all increased amid the disruption caused by COVID-19.
However, the pandemic has not completely dominated the arbitration industry. Other issues include ‘green’ arbitration, transparency, diversity and the efficiency of international arbitration. Organisations are encouraging changes to practices that promote ‘greener’ arbitrations, such as allowing virtual hearings to limit travel and providing for digital submissions. The restrictions mandated by the COVID-19 pandemic forced new pathways, but there is more work to be done and a ‘one size fits all’ approach may not be appropriate.
As recent years have demonstrated, technology has a key role in the future of international arbitration. To that end, some organisations, such as the Chartered Institute of Arbitrators (CIArb), have issued new guidelines due to the step-change in technology over the last decade. Practitioners must keep up to date with new developments to ensure that arbitration remains fit for purpose in a technology-driven, post- COVID-19 society.
