Instances of restructuring and insolvency have, on the whole, dwindled over the last 12 months. Governments around the world introduced support schemes and legislative measures to help companies keep their heads above water during the worst of the coronavirus (COVID-19) pandemic. However, as many of those schemes have now been withdrawn, and with economic and geopolitical uncertainty rife, the number of companies requiring restructuring and insolvency services has begun to rise once more.
Yet the restructuring and insolvency space has been changed by the pandemic. Like many other industries, it had to cope with significant operational challenges. The introduction of remote working and virtual hearings, for example, reshaped the industry over the last two years.
As we approach the post-pandemic era, insolvency and restructuring practitioners will have to adapt to the new normal. The pandemic was the catalyst for temporary changes to the industry, but in many jurisdictions these changes crystalised, leading to more permanent shifts in insolvency processes. Over the last couple of years, some jurisdictions have reassessed the desirability and practicality of their insolvency and restructuring frameworks.
